DHS Possible Action on clearing EB2 and EB3 backlogs ?
The Department of Homeland Security continues to work in improving the current immigration system by predicting and allocation Employment-Based visa numbers more accurately in line with the EO of President on Immigration reform for Legals. One Main concern by all and most likely to be implemented soon is allowing those with approved I-140s to file an I-485 application even without a current priority date and ensure the backlogs are cleared, This will provide EAD for all those who will file for AOS . We predict the agency recommendations will have a solution to the backlog by allowing individuals to file the I-485 application in advance of the priority date being current and most of the comments have raised this concern .Other Important actions might include to allow recapture of previously unused green cards and changing the way dependents are counted.
If the agency decides to execute a rule as final they may not have a comment period which is of 30 to 60 days and may issue a final rule directly in Special cases. We anticipate the rule could be published very possibly.
