H1B with Desi companies with Bonds? Should you Care?
Lots of Desi consulting companies before filing your H1b , makes you sign some Bond. Some are like below:
1) If you quit within 12 months, pay 15K usd
2) Desi companies may ask for deposit for the whole visa cost, and tell you they will return back, when you complete couple of months.
3) Also there are Desi companies companies which do not pay you your air ticket, and tell you once u get a project, it will be re-imbursed.
All such steps are to protect their profits and investment in your H1B visa. Consulting company spends almost 3000-4000 dollars in your application and filing your h1b and then spend some more money for your air ticket ,accommodation and other expenses until you are placed in the project. And if a consultant quits after finding a project they tend to loose their money invested on you.
All these Bonds will not carry any legal value . As per laws, H1B folks are not to be bonded and they can work for any company who sponsors/transfers their H1b. Since people who are coming new to USA on h1B are not aware of laws and are more keen on getting settled , Desi consultant companies tend to scare them with legal talks and exploit them.
We would strongly recommend, if you are not happy with your company, quit it, these bonds are meaningless. You can quit and join any company and you are not a bonded labor .
Desi company can may pester you to pay bond breakage charges and you can tell them to contact your collection/employment attorney to discuss the case .And sure none of desi consultancy would like to fight a case .
If you are worried about loosing deposit money, would recommend to forget it. If you have a well paying opportunity job go get it ,its well worth it.
